1. Acceptance of Terms

By accessing and using the NowMeLive AI Website Builder, Ecommerce, and Marketplace platform ("Service"), you ("User," "Merchant," or "Customer") agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

NowMeLive is a Software-as-a-Service (SaaS) platform that enables users to build AI-powered websites, manage inventory, handle billing and invoicing, and operate standalone e-commerce stores or participate in a unified marketplace.

3. Merchant Responsibilities

Merchants utilizing NowMeLive to sell goods or services are solely responsible for:

  • Ensuring all products/services comply with Indian laws, including the Consumer Protection (E-Commerce) Rules, 2020.
  • Providing accurate product descriptions, pricing (inclusive of GST), and transparent return/refund policies.
  • Fulfilling orders promptly and handling customer support for their respective buyers.
  • Obtaining necessary consents from their customers regarding data processing, as NowMeLive acts only as a Data Processor for end-customer data.

4. Customer Responsibilities

Customers purchasing items from Merchants on the NowMeLive Marketplace agree that NowMeLive acts as a technology facilitator. While we enforce strict Merchant KYC and quality guidelines, the ultimate contract of sale is between the Customer and the Merchant.

5. Fees, Billing, and Wallets

Access to certain NowMeLive features requires a prepaid wallet balance. Fees are calculated based on your active limits and deducted from your wallet on an hourly or usage-based interval. You are required to maintain a positive wallet balance to keep services active. All fees are exclusive of applicable taxes (e.g., GST) unless explicitly stated otherwise.

If your wallet balance falls below the amount due for the current invoice period, your account enters a grace period. Payment of any due or negative balance is extended up to 20 days. If the due amount is not settled within this 20-day grace period, NowMeLive reserves the right to immediately suspend your services until the balance is cleared.

6. Intellectual Property

All intellectual property rights in the NowMeLive platform (software, AI models, UI/UX) belong to NowMeLive. Merchants retain full ownership of the original content, logos, and data they upload to their respective stores.

7. Limitation of Liability

To the maximum extent permitted by Indian law, NowMeLive shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service, including but not limited to lost profits, data loss, or business interruption.

8. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts located in [Insert City/State], India.
